Thank you for visiting restaurantequipment.com, an e-commerce site operated by Cresco-Resco.   We value you as a customer and appreciate your business.  It is our goal to provide you with competitive prices for all your restaurant equipment and kitchen supply needs.  We strive to present you with the most accurate information directly from our manufacturers, suppliers, and shipping carriers. Please take a moment to review our policies along with our terms and conditions.  It is important for you to understand how you are protected as a consumer and that Cresco-Resco can only conduct business under these terms.

Information and Site Content

Discrepancies and potentially incorrect information may be present on Cresco-Resco’s website.  Contact our customer care team at 1-800-443-1400, submit an online message, or use Live Help, with any questions.  We want to correct any missing or inaccurate information as quickly as possible.

Prices

Prices are subject to change without prior notification.  If you have submitted an authorized payment on an online order and an increase in shipping fee emerges greater than 15%, we will contact you for approval before processing your order.

Pictures

All pictures shown on our website are the best available at the time the item is added to our website.  Pictures may also contain optional accessories which must be purchased separately.

Availability

Products and services at Cresco-Resco may have limited or no availability due to your geographical location, an item being discontinued by the manufacturer, or an item being on back order due to increased demand.   We strive to fulfill every order in a timely manner.  We will work with you to replace or substitute items in instances where your preferred item(s) is not available. 

Payments

We accept all major credit cards including Visa, Mastercard, American Express, and Discover.   For your convenience we allow the option of making payment through your trusted credit card processor such as Amazon Pay, Apple Pay, Facebook Pay, Google Pay.  To prevent fraud, we may require documentation to verify the card.  All transactions are conducted in USD.

Financing 

We offer financing on a selection of equipment and supplies.   For more information on this process, please visit our Available Financing page.   Our Financing Program is powered and operated by a partnered third party.   Any questions after completing and submitting this application should be directed to the contacts listed on our Available Financing page.

Credit Card Processing

When your credit card is submitted at the end of the ordering process, our credit card processor places a temporary “hold” is placed on your credit card for the amount of your order. The hold amount may be visible on your bank’s online portal as “pending”.   This hold may be active for up to 14 days.   However, your credit card is not actually charged until Cresco-Resco fulfills and ships your order, at which time the card is captured.

If your order cannot be fulfilled, Cresco-Resco will cancel the order and the funds will be released to your credit card.   

In the event your payment is captured Cresco-Resco will issue you a refund.   The refund will be issued back to the original payment method.   Please allow 3-5 business days for this process to be completed before following up with an email to customerservice@restaurantequipment.com.

Sales Tax

Laws regarding sales tax vary by location and undergo frequent change in content as well as interpretation by government agencies.  Cresco-Resco will make every effort to comply with the law and government regulations.   Customers, (business or individual) are responsible to report purchases shipped across state lines.  Customers are liable to pay any applicable state and local sales taxes.  Cresco-Resco conducts business within the states of California, Colorado, and Nevada.  Therefore, Cresco-Resco collects sales tax for orders billed or shipped to these states.

Items may be shipped directly from the manufacturer to the customer.  Manufacturers are required to collect sales tax on shipments made to the states in which they conduct business.  Cresco-Resco is required by law to collect all applicable sales taxes in such cases.

All sales taxes applied to purchases where applicable by law will be present on your sales order.

Tax Exemption

If your business is tax-exempt, submit your tax exemption form to customerservice@restaurantequipment.com.  Your form will be vetted and applied if all the requirements are met.  Please allow 1-3 business days for this process to be completed before following up with an email.

Warranty

Some items come with manufacturer warranties.  These warranties are issued for commercial use only.  Warranties will be voided on any item(s) used for non-commercial purposes.  Once purchase is complete any questions inquired will be redirected for the customer to reach out to the manufacturer.  Warranties are not the responsibility of Cresco-Resco.

Dispute Resolution

Cresco-Resco values its relationship with its customers.  We believe arbitration is more conducive to prompt, fair and cost-effective resolution in the event a dispute arises.

If a dispute arises between you and Cresco-Resco, and if the dispute cannot be settled through negotiation, you and Cresco-Resco agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to some other dispute resolution procedure.

Any controversy or claim which is not resolved in mediation, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial [or other] Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

All parties consent to venue for both mediation and arbitration in Fresno, California and waive any defense of lack of personal jurisdiction.  The only exceptions to the mediation and arbitration provisions above are: any violation of Cresco-Resco intellectual property rights, for which Cresco-Resco may seek injunction and/or other appropriate relief in any manner chosen by Cresco-Resco.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, related to or connected with the use of the Cresco-Resco site or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever banned.

Disclaimer and Limitation of Liability

EXCEPT AS OTHERWISE PROVIDED IN THE STANDARD TERMS OF SALE THAT GOVERN THE SALE OF EACH PRODUCT ON THIS SITE, THE PRODUCTS OFFERED FOR SALE ON IT AND THE TRANSACTIONS CONDUCTED THROUGH IT ARE PROVIDED BY US ON AN "AS IS" BASIS.  WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS.  TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, TITLE, QUIET ENJOYMENT, DATA ACCURACY AND SYSTEM INTEGRATION.  THIS SITE MAY INCLUDE INACCURACIES, MISTAKES OR TYPOGRAPHICAL ERRORS.  WE DO NOT WARRANT THAT THE CONTENT WILL BE UNINTERRUPTED OR ERROR FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, SPECIAL OR CONSEQUENTIAL DAMAGES.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES (REGARDLESS OF THE FOUNDATION FOR THE ACTION) SHALL NOT EXCEED IN THE AGGREGATE THE AMOUNT OF FEES PAID BY YOU TO US DURING THE MONTH IMMEDIATELY PRECEDING THE ACT ALLEGEDLY GIVING RISE TO OUR LIABILITY.

Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or product information received from our suppliers, we shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.  We shall have the right to refuse or cancel any such orders whether the order has been confirmed and your credit card charged. 

International Users

Restaurantequipment.com is controlled, operated and administered by Cresco Resco from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. We do not ship outside of the USA. You agree that you will not use the Cresco Resco Content in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
